2. Services and Payments
Payment Structure
- For projects exceeding USD 521, a 50 percent upfront payment is required before work begins, with the remaining 50 percent due after preview and prior to final delivery.
- For projects at or below USD 521, 100 percent upfront payment is required.
- Work will not begin until the required payment has been received.
Non-Refundable Policy
- Once payment is made and work has commenced, orders are non-refundable unless otherwise agreed upon in writing by Joshua Cote.
- Feature additions, scope changes, or modifications requested after payment may require additional fees and timeline adjustments.
Refunds
Any refund is at the sole discretion of Joshua Cote and, where granted, is subject to these Terms. If payment was made in cryptocurrency, any refund shall be calculated and paid based on the USD equivalent of the payment at the time the payment was made, and not on the cryptocurrency amount or its value at the time of refund.
Right to Refuse Service
Joshua Cote reserves the right to refuse service or cancel any order prior to receiving payment, at their sole discretion.
3. Chargebacks and Payment Disputes
- All payments made are considered authorized and confirmed by the client.
- In the event of a chargeback or payment dispute, Joshua Cote reserves the right to suspend or terminate services immediately.
- Joshua Cote will contest chargebacks using all available documentation, including communication records, project files, and delivery proof.
- False claims of unauthorized transactions may result in service termination and legal action where applicable.
Any chargeback fees, penalties, or administrative costs incurred as a result of a dispute may be invoiced to the client where permitted by law.
4. Intellectual Property and License
- Upon full payment: You are granted a non-exclusive, transferable license to use and resell the delivered work.
- You may not claim authorship or represent the work as your original creation unless explicitly agreed in writing.
- Unauthorized copying, redistribution, or use of copyrighted materials may result in legal action as permitted by law.
- Joshua Cote retains the right to display completed work in portfolios or promotional materials unless otherwise agreed.
5. Delivery, Delays, Support, and Backups
Delivery Delays
While timelines are respected, delays may occur due to unforeseen circumstances including but not limited to personal emergencies, religious events, or technical issues.
- The project will still be completed.
- No refunds or cancellations will be issued due to delays alone.
- Compensation may include additional support time at no extra cost.
Warranty and Support
- All completed projects include a 1 month (30 days) free warranty period starting from the date of delivery.
- Bugs or issues must be reported in writing within this period to qualify for free fixes.
- Issues not reported during the warranty period may require paid support.
- Products delivered more than 3 months prior do not qualify for free support unless otherwise agreed.
Backups
Once files or deliverables have been delivered to you, Joshua Cote is not responsible for providing or maintaining any backups of such materials. You are responsible for keeping your own copies of all delivered work.
6. Termination
Once you have paid and work has commenced, you may not cancel the project or demand a refund; all payments are final except where Joshua Cote agrees otherwise in writing.
Joshua Cote may, at any time and at their sole discretion, issue a refund and/or terminate the contract. Any such refund or termination is voluntary and does not create an obligation to refund or terminate in any other case.
If you halt or abandon the work at any point—for example, by ceasing communication, instructing that work stop, or otherwise disengaging—no refund or compensation will be provided, unless Joshua Cote and you mutually agree in writing to pause the project and resume at a later date.
7. Disclaimer
All materials and services are provided on an “as is” basis. Joshua Cote makes no warranties, expressed or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
